Liberty, Equality, and Due Process: Cases, Controversies, and Contexts in Constitutional Law (Third Edition)
Usually printed in 3 - 5 business days
This Casebook is intended to be used in a course that concentrates on Constitutional Rights and centers on the Fourteenth Amendment. It begins with the threshold issue of “state action” and other basic principles of constitutional law including judicial review and constitutional interpretation. The Casebook treats equality extensively, including slavery before the Reconstruction Amendments, equal protection for racial, gender, and other classifications, affirmative action, and fundamental rights in equal protection doctrine including the development of doctrine and the most recent cases. It emphasizes substantive due process, including unenumerated rights and the process of incorporation, including the Second Amendment. The brief last Chapter raises questions of state constitutional rights.
The Third Edition also exists as an interactive eBook at lawbooks.cali.org and includes approximately 100 interactive “Check Your Understanding” questions for students to monitor their own mastery throughout the cases and materials. The print edition includes links to the interactive questions. You can use the interactive version for free from CALI's eLangdell Press website.
