The Arkansas Real Estate Title Standards project began in 1995. There are two primary reasons behind the development of title standards in Arkansas. The first reason is to set forth a uniform set of standards for the examination of title to Arkansas real property. This should reduce burdensome and unnecessary curative re¬quirements that might otherwise be made by "overly-meticulous" title examiners.
A second and equally important reason for the publication of these standards is to insure and preserve the attorney's role and input in professional standards affecting title examination. With ever-changing technology and evolving business practices in our modern world, this role appears to be diminishing. Since title examination should be conducted only by licensed attorneys and because these standards will have a direct impact on the way attorneys examine title, the promulgation of title standards should originate from Arkansas lawyers.
