“DYNAMIC LINKED LIBRARIES”: Paradigms of the GPL license in contemporary software

Free Software has transformed life on the planet. However, License compatibility has become a real challenge because of the GPL license copyleft restrictions. The Free Software Foundation provides an interpretation of the GPL license in the field of linking program libraries applying different criteria such as modification, dependency, interaction, distribution medium, and location. These criteria goes beyond the traditional derivative works framework established in national copyright laws, and international copyright conventions. However, the GPL license as a copyright license has to be interpreted by Judges of different jurisdictions and different legal traditions. What is the relation between copyleft and derivative works? Should software be treated as literary works? Should copyright law be updated? How do we apply linking exceptions? Are the GPL prescriptions proportional? How would they fall into fair use exceptions? These and other questions will be covered in this work.
