Employee with Arthritis: Is the employee disabled or not?

An employer encounters difficulties in defining if an employee who suffers arthritis is disabled. For this research an open investigation case from the U.S. Equal Employment Opportunity Commission will be discussed to analyze the employer’s implications if the employee is terminated according to the definition of “disability” under the EEOC. United States government laws and opinions from experts in this field will be presented to reach a conclusion if the employee is disabled. This conclusion may differ from the findings of the EEOC investigators.
