As a contribution to the world peace and security, this book seeks to find a clear legal solution to the Senkaku/Diaoyu Islands sovereignty dispute between China and Japan within the framework of the UN Charter. In order to achieve this, this book aims to find answers to two critical legal questions pertaining to Senkaku /Diaoyu Islands sovereignty dispute. The first question is whether the Japanese Cabinet Decree of 14 January 1895 created any rights for Japan under international law and whether it may be used to nullify Article 3 of the San Francisco Peace Treaty. The second question is whether the Allies have made a lawful decision based on the 1945 Instrument of Surrender of Japan in the 1951 San Francisco Peace Treaty. Using the United Nations legal system, this book tries to find answers to these two questions, which should be binding under Article 103 of the UN Charter to solve the dispute between China and Japan forever for the Senkaku/Diaoyu Islands dispute.
