Environmental rights exist at the junction of environmental protection and human rights. They have taken hold in constitutions and courts across the globe and are of increasing cognizance under international governance regimes. Approximately 4 in 5 human beings in the world live in a legal system that recognizes environmental rights under international, domestic or subnational law. Furthermore, there is increasing effort for global recognition of a right to a healthy environment, in part fueled by domestic developments. With essential excerpts from international law, constitutions, statutes, cases and important perspectives, ENVIRONMENTAL RIGHTS: CASES, CONTEXTS AND COMMENTARY examines the evolution and implementation of international, regional, and domestic legal means for advancing environmental rights, including human rights and the environment; constitutional instantiation of environmental rights, including a right to a healthy environment; and cross-cutting issues, such as rights to dignity and a stable climate, and of nature and animals. It includes essential readings and major judicial decisions in these fields.
