This text examines the compatibility of CPOs and human rights. Through the prism of the European Convention on human Rights (which incorporates the Human rights Act 1998) and applicable international human rights conventions.
It examines the underlying practical policies, practices and decisions. Such as consultation, internal processes, viability reports, environmental or equality matters, planning permission juxtaposed with the adverse impact on residents and settled communities. Especially in fundamental life indicator areas, like employment, finances, culture, health and the disproportionate impact on racial minorities.
Crucially the book also challenges the compensation of CPO affected residents due to the cumulative injurious effects in many areas of their lives which inevitably attaches the jurisdiction of the ECHR and HRA 1998. In the concluding chapters, the book examines whether the associated legal remedies are practically or meaningfully enforceable and suggests proposals for reform.
