International Commercial Arbitration

International commercial arbitration (“ICA”) is a form of alternative dispute resolution that is utilized to resolve international commercial disputes arising between parties in different national jurisdictions. ICA is unique among the many forms of dispute resolution in that the arbitral tribunal, which consists of one or several arbitrators chosen by the parties, has the authority to be fully autonomous of state court intervention. The arbitral tribunal is often thought of as its own new encompassing forum, which applies its own, often ad hoc, rules and procedures. The arbitral tribunal caters to neutral ground, allowing parties from different jurisdictions to resolve their dispute more amicably than other more “formal” procedures. Written submissions are exchanged by the disputing parties and hearings are conducted before the tribunal, which receives additional party-relied testimony in the form of witness examinations.
